Program Background
The Australia Indonesia Partnership for Justice Phase 3 (AIPJ3) is a five-year, A$63 million investment by the Australian Department of Foreign Affairs and Trade (DFAT) to work in partnership with the Government of Indonesia (GOI) to support advancement of its priority law and justice reforms. Building on previous phases, AIPJ3 will support partners to deliver activities against agreed policy priorities, while maintaining flexibility to respond to emerging needs and opportunities. The program focuses on seven policy priorities that are important to Australia and Indonesia: accountability and transparency, criminal justice reform, preventing violent extremism, transnational crime cooperation, commercial law, access to justice, and women’s leadership.

The Role
The preparation of these policy recommendations will support the government’s efforts to implement the Priority Project “Application and Enforcement of Civil Law with Legal Certainty,” as outlined in the 2025–2029 National Medium-Term Development Plan (RPJMN). This support is directed toward the preparation of a comprehensive study on strengthening alternative dispute resolution mechanisms in Indonesia that can accommodate the development of cross-border transactions to create a conducive business climate with swift and certain law enforcement, one of the strategies for which is the strengthening of commercial mediation. Furthermore, this initiative will support Indonesia’s commitment in the Organisation for Economic Co-operation and Development (OECD) accession process, which emphasizes the importance of enhancing the effectiveness of alternative dispute resolution (out-of-court) mechanisms.
In carrying out this assignment, the STA will:
- Assess the current state of affairs and identify various challenges in the implementation of mediation in out-of-court dispute resolution to date;
- Conduct a comparative study (benchmarking) of best practices in mediation at the global level; and
- Formulate the policy recommendations for strengthening mediation as input for regulatory improvement related to alternative dispute resolution.

About You
Roles and Responsibilities
The STA will support the preparation of these policy recommendations through the following activities and responsibilities:
- Conducting literature reviews and collecting relevant data;
- Assessing and mapping issues related to mediation as an alternative to out-of-court dispute resolution, both from a normative and empirical perspective;
- Conducting comparative studies of best practices in mediation globally, including studies on the regulation and implementation of commercial mediation in several countries;
- Supporting the implementation of focus group discussions (FGDs), consultations, and interviews with stakeholders and experts;
- Completing all deliverables on schedule and in accordance with agreed-upon quality standards;
- Presenting interim and final findings to Bappenas and relevant stakeholders to obtain feedback and validation;
- Incorporating feedback from the validation process into the final versions of all deliverables.
Expected Outcomes
- Problem Mapping: Identification of key issues, both normative and empirical, in the implementation of mediation in out-of-court dispute resolution.
- Mapping of Best Practices: The development of a mapping of best practices in mediation as a means of out-of-court dispute resolution, including an effective institutional framework, procedural models, and regulatory approaches that support legal certainty, accessibility, and the enforceability of mediation outcomes.
- Policy Recommendations: The formulation of strategic policy recommendations to strengthen the position of mediation as a mechanism for out-of-court dispute resolution, including strategies to enhance the enforceability and accessibility of mediation outcomes and the design of regulatory, institutional, and procedural improvements to accommodate dispute resolution through mediation.
Selection Criteria
Essential Experience and Knowledge
- Hold a master’s degree or higher in civil law, dispute resolution, international relations, or a related field from a reputable university.
- Have at least 10 years of professional experience in civil law, dispute resolution, in particular alternative dispute resolution, cross border transactions including investment and international law, or a related field.
- Possess a strong understanding of regulations related to dispute resolution through mediation in Indonesia.
- Have experience collaborating with government agencies, development partners, research institutions, or stakeholders in the fields of in particular alternative dispute resolution, cross border transactions including investment and international law.
- Possess strong skills in coordination, policy analysis, legal research, report drafting, and stakeholder engagement.
- Have been involved as a team member or expert in policies formulation on alternative dispute resolution or any related topics at the international level.
- Submission of relevant supporting documents (CV, certificate, diploma, proposed research outline, etc.) is required upon application.
Desirable
- Has experience in preparing studies, regulatory analyses, or policy recommendations related to dispute resolution system reform, particularly mediation, civil law enforcement, and improving the investment climate.
- Has experience in facilitating focus group discussions (FGDs), policy consultations, and multi-stakeholder discussions involving ministries/agencies, professional organizations, academics, the public, and other relevant stakeholders.
- Holds a professional certification in the field of alternative dispute resolution at the international levels
- Demonstrate proficiency in English, both written and oral, to review international literature and comparative global frameworks, as well as, when necessary, prepare summaries of findings and facilitate discussions in English.
- Have experience in conducting comparative studies or benchmarking of global best practices, particularly regarding their potential adaptation and implementation within the context of policy and regulatory governance in Indonesia.
