Program Background

The Australia Indonesia Partnership for Justice Phase 3 (AIPJ3) is a five-year, A$63 million investment by the Australian Department of Foreign Affairs and Trade (DFAT) to work in partnership with the Government of Indonesia (GOI) to support advancement of its priority law and justice reforms. Building on previous phases, AIPJ3 will support partners to deliver activities against agreed policy priorities, while maintaining flexibility to respond to emerging needs and opportunities. The program focuses on seven policy priorities that are important to Australia and Indonesia: accountability and transparency, criminal justice reform, preventing violent extremism, transnational crime cooperation, commercial law, access to justice, and women’s leadership.

The Objectives of the Role

The preparation of these policy recommendations will support the implementation of the Regulatory Governance Transformation agenda as mandated under the 2025–2029 RPJMN, particularly under the Priority Activity on Improving Regulatory Quality, one of whose strategies is strengthening public participation. In addition, this initiative will support Indonesia’s commitment in the OECD accession process, which emphasizes the importance of high-quality, transparent, accountable, and participatory regulations.

In carrying out this assignment, the Adviser will:

• Conduct a mapping of the existing conditions and key challenges in the implementation of public participation in the law and regulation making process;
• Undertake comparative studies (benchmarking) on global good practices related to public participation; and
• Develop policy recommendations on strengthening public participation as input for improving regulatory governance business processes.

Roles and Responsibilities

• The Adviser will support the preparation of these policy recommendations through the following activities and responsibilities:
• Conduct literature reviews and collect relevant data and information;
• Undertake assessments and mapping of challenges related to public participation in the formulation of law and regulation, both from normative and empirical perspectives;
• Conduct comparative studies on global good practices in public participation, including reviews of public participation guidelines adopted in several advanced countries in line with Good Regulatory Practice (GRP) principles;
• Assist in organizing focus group discussions (FGDs), consultations, and interviews with stakeholders and experts;
• Produce all deliverables in accordance with the agreed timeline and quality standards established at the inception stage;
• Present interim and final findings to Bappenas and relevant stakeholders for feedback and validation; and
• Incorporate feedback from the validation process into the final versions of all deliverables.

About You

Selection Criteria

Essential Experience and Knowledge

• Holds a master’s degree in law, human rights, public policy, public administration, governance, political science, or other related fields from a reputable university.
• Has at least 7 years of professional experience in the fields of law and regulation making, democracy, human rights, governance, public policy, or other related areas.
• Possesses a strong understanding of democratic and human rights principles in the law and regulation   making process.
• Demonstrates an understanding of meaningful public participation in the formulation of law and regulation.
• Demonstrates an understanding of national development policies as well as the legal and institutional frameworks related to the formulation of laws and regulations.
• Has experience working with government institutions, development partners, research institutions, civil society organizations, or other stakeholders on issues related to regulatory democracy, human rights, regulatory governance, and public policy, proven by related document.
• Possesses strong skills in coordination, policy analysis, legal research, and stakeholder engagement, backed by a track record of publications, with publications in reputable international journals preferred.
• Possesses strong written and verbal communication skills in English, as evidenced by the attached English proficiency certificate (minimum equivalent of IELTS 6.5 or TOEFL iBT 80) or a degree obtained from an international program conducted entirely in English.
• Submission of relevant supporting documents (CV, certificate, diploma, proposed research outline, etc) is required upon application.

Desirable

• Has experience in preparing studies or policy recommendations related to democracy, human rights, public participation, or regulatory governance.
• Possesses experience assisting the government in drafting Academic Papers (Naskah Akademik RUU) for bills within the last three years.
• Has experience in facilitating focus group discussions (FGDs), policy consultations, and multi-stakeholder discussions involving ministries/agencies, civil society organizations, academics, communities, and other relevant stakeholders.
• Demonstrates proficiency in English for reviewing international literature and comparative global frameworks and, where required, preparing summaries of findings and facilitating discussions in English.
• Has experience in conducting comparative studies or benchmarking on global good practices, particularly regarding their potential adaptation and implementation within Indonesia’s policy and regulatory governance context.
