About the Proposal

The Australia Indonesia Partnership for Justice Phase 3 (AIPJ3) is a five-year, A$63 million investment by the Australian Department of Foreign Affairs and Trade (DFAT) to work in partnership with the Government of Indonesia (GOI) to support advancement of its priority law and justice reforms. Building on previous phases, AIPJ3 will support partners to deliver activities against agreed policy priorities, while maintaining flexibility to respond to emerging needs and opportunities. The program focuses on seven policy priorities that are important to Australia and Indonesia: accountability and transparency, criminal justice reform, preventing violent extremism, transnational crime cooperation, commercial law, access to justice, and women’s leadership.

Strengthening the handling of marriage dispensation applications is a key component of AIPJ3's efforts to improve access to justice and child protection in Indonesia. Marriage dispensation proceedings have significant implications for children's protection and future wellbeing. In practice, judges often have limited information about a child's circumstances, including their family situation, physical and mental health, educational continuity, protection risks, and support service needs when examining and deciding marriage dispensation applications. This can limit the court's ability to comprehensively assess the best interests of the child.

To strengthen child protection in these proceedings, the Ministry of Women's Empowerment and Child Protection (KPPPA), with support from the Australia–Indonesia Partnership for Justice Phase 2 (AIPJ2), developed a draft Guideline for the Preparation of Child Protection Reports in Marriage Dispensation Applications, including a Child Protection Report (Laporan Perlindungan Anak/LPA) template. The LPA is intended to provide judges with comprehensive information to support informed decision-making. However, following consultations with KPPPA and other key stakeholders, the draft guideline and LPA require further refinement to improve their practicality, strengthen implementation arrangements, and better support their consistent use by Pusat Pembelajaran Keluarga (PUSPAGA).

About the Engagement:

AIPJ3, in partnership with KPPPA, seeks a qualified Subcontractor to provide technical expertise to refine the LPA, develop an implementation mechanism and Standard Operating Procedure (SOP) for its use within PUSPAGA, strengthen referral arrangements with relevant services, and prepare a practical handbook to support its effective implementation.

The objective of the service aims to strengthen child protection in marriage dispensation proceedings by improving the quality of the LPA and supporting its effective implementation within PUSPAGA. Specifically, the consultancy seeks to:

  • Improve the quality and practicality of the LPA to better support child-centred decision-making in marriage dispensation cases.
  • Establish a clear and consistent process for the preparing and implementing the LPA within PUSPAGA, including coordination and referral arrangements with relevant stakeholders.
  • Strengthen the capacity of PUSPAGA personnel to prepare and use the LPA effectively and consistently.
  • Promote a more coordinated and standardised approach to child protection assessments in marriage dispensation proceedings.

The Expected Outcomes

  • A strengthened LPA that is practical, comprehensive, and fit for use in marriage dispensation proceedings.
  • A clear and standardised process for preparing and implementing the LPA within PUSPAGA, including defined coordination and referral arrangements with relevant stakeholders.
  • Improved capacity of PUSPAGA personnel to prepare and apply the LPA consistently and effectively.
  • More consistent and comprehensive child protection assessments to support judges in making decisions that uphold the best interests of the child.

The interested organisations must submit the required proposal documents to AIPJ.General@aipj.or.id before the submission deadline of 16 August 2026 at 23:59 Jakarta time (GMT+7). Hardcopies are not required, and late submissions cannot be accepted.
